OPENING HOMEOWNER ASSOCIATION POOLS IN CALIFORNIA
We are pleased to report some very good news on the reopening of your swimming pools!!! The CDPH has confirmed to us that homeowner associations are now permitted to open and operate their swimming pools in accordance with applicable local jurisdictions.
Just last week, we shared with you the CDPH website (https://covid19.ca.gov/roadmap-counties/) which stated that public pools (which includes HOAs) are not permitted to operate in the State of California at this time. This has caused tremendous confusion, especially because some counties have expressly allowed HOA pools to reopen, including Los Angeles, Riverside and San Bernardino Counties. Our clients in these counties have been hesitant to reopen their pools because of the CDPH’s order directing them not to.
To resolve this conflict, we reached out directly to the CDPH and explained the conflict their website is causing. CDPH representatives confirmed to us that the State’s order on the above-referenced website is not intended to prohibit the operation of homeowner association pools in California, and that HOA pools may operate in California in accordance with local guidance and requirements. The CDPH will be looking to update its website to reflect that HOA pools are exempt from the State Order.
With this new development, we are now advising our clients that they may reopen their swimming pools in full compliance with all local regulations. Please call us to help you navigate the rules of your local jurisdiction.
